By accessing and using Skillan's services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not use our services.

These terms constitute a legally binding agreement between you (the "User" or "Customer") and Skillan ("we," "us," or "our"). By creating an account or using our platform, you acknowledge that you have read, understood, and agree to be bound by these terms.

Skillan is a SaaS platform that provides AI-powered candidate screening and evaluation tools for recruitment and human resources professionals. Our services include:

• AI-powered CV analysis and candidate screening
• Automated candidate evaluation and scoring
• Job search and requisition management
• Selection pipeline and candidate tracking
• Collaborative evaluation tools and reports

We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with or without notice, although we will make reasonable efforts to notify users of significant changes.

To use Skillan, you must create an account. By registering, you agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Be at least 18 years of age or have legal authority to enter into this agreement
• Notify us immediately of any unauthorized access or security breach

Available Plans

• Free Plan: 10 CVs at no cost (default for new signups)
• Starter Plan: 750 credits per month for $79/month
• Pro Plan: 3,000 credits per month for $199/month
• Business Plan: 7,500 credits per month for $449/month
• Enterprise Plan: 15,000 credits per month for $799/month

Payment Terms

All paid subscriptions require advance payment via credit card, debit card, or other accepted payment methods. Subscriptions automatically renew at the end of each billing cycle unless cancelled.

You authorize us to charge your payment method for all fees incurred. If payment fails, we may suspend or terminate your access to paid features after providing reasonable notice.

Price changes will be communicated at least 30 days in advance. Continued use of the service after a price change constitutes acceptance of the new pricing.

New users receive 10 free CV analyses at no cost. This free plan continues indefinitely unless you choose to upgrade.

For paid plans, we offer a 7-day money-back guarantee from the date of your initial subscription. Refund requests must be submitted via email to [email protected] within this period.

The money-back guarantee applies only to your first subscription period and does not apply to renewals, upgrades, or add-on purchases.

You agree not to use Skillan's services for any unlawful purpose or in any way that violates these terms. Prohibited activities include:

• Discriminatory hiring practices that violate applicable employment laws
• Uploading malicious code, viruses, or any content that could harm our systems
• Attempting to access unauthorized areas of the platform or other users' accounts
• Using the service to violate any person's privacy or intellectual property rights
• Scraping, data mining, or automated data collection without explicit permission
• Reselling, redistributing, or providing access to the service to unauthorized third parties

Violation of this acceptable use policy may result in immediate suspension or termination of your account without refund.

All intellectual property rights in the Skillan platform, including but not limited to software, design, trademarks, logos, and content, are owned by Skillan or our licensors.

Your subscription grants you a limited, non-exclusive, non-transferable license to use the service during your subscription term. You may not copy, modify, reverse-engineer, or create derivative works from our platform.

You retain all rights to the candidate data and content you upload to Skillan. By using our service, you grant us a limited license to process and analyze this data solely for the purpose of providing our services to you.

We take data privacy and security seriously. All candidate data is encrypted in transit and at rest. We implement industry-standard security measures to protect your information.

We process personal data in accordance with applicable data protection laws, including GDPR and other relevant privacy regulations. You are responsible for ensuring you have the legal right to upload and process candidate data on our platform.

We strive to maintain 99.5% uptime on a monthly basis. This guarantee excludes scheduled maintenance, force majeure events, and issues beyond our reasonable control (such as internet service provider outages).

We will make reasonable efforts to notify users of scheduled maintenance in advance. Emergency maintenance may be performed without notice if required to protect the security or integrity of the platform.

If we fail to meet the 99.5% uptime guarantee in any given month, affected customers on paid plans may request a service credit equivalent to one month of their subscription fee.

Skillan is provided "as-is" without warranties of any kind, either express or implied. We do not guarantee that the service will be uninterrupted, error-free, or meet your specific requirements.

To the maximum extent permitted by law, Skillan's total liability for any claims arising from or related to the service is limited to the amount you paid us in the 12 months preceding the claim.

We are not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, data loss, or business interruption, even if we have been advised of the possibility of such damages.

You may cancel your subscription at any time by contacting us at [email protected]. Cancellations take effect at the end of your current billing cycle, and you will not be charged for subsequent periods.

We reserve the right to suspend or terminate your account immediately if you violate these terms, engage in fraudulent activity, or fail to pay outstanding fees after reasonable notice.

Upon termination, your access to the service will be revoked. You are responsible for exporting any data you wish to retain before termination, as we do not guarantee data retention after account closure.

If your account is terminated for violating these terms, you will not be eligible for any refund of prepaid fees.

We may update these Terms and Conditions from time to time. When we make changes, we will update the "Last Updated" date at the top of this document and notify you via email or through the platform.

Your continued use of Skillan after changes to these terms constitutes your acceptance of the updated terms. If you do not agree with the changes, you must discontinue use of the service and cancel your subscription.

These Terms and Conditions are governed by the laws of Argentina, without regard to conflict of law principles.

Any disputes arising from or relating to these terms or your use of Skillan will be resolved through binding arbitration in Buenos Aires, Argentina, in accordance with the rules of the Argentine Arbitration Association.

You and Skillan agree to waive any right to a jury trial or to participate in a class action lawsuit or class-wide arbitration.
